Mediation & Arbitration Services

Choosing the right arbitrator or mediator for the resolution of your business dispute is the first and perhaps most significant decision you will make in the dispute resolution process. Parties to the dispute need an arbitrator or mediator, as applicable, who understands not only the underpinning of the matter, but also the general background of the business or industry in which it arises.  Arbitration, in particular, can be voluntary if all parties agree, but is often the result of a contractual requirement. In commercial contracts between businesses and individuals, it is now common practice to include alternative dispute resolution clauses (i.e., alternative to costly, protracted litigation). An efficient and effective dispute management clause will facilitate dispute prevention and efficient resolution, save time and cost, and provide better confidentiality protection. Furthermore, it allows parties to establish ground rules of any future dispute, to submit current disputes for more efficient resolution, and allows arbitrators and mediators with subject matter expertise to assist in resolving these disputes.

Mediator Services

Mediation is an informal negotiation assisted by an impartial third party (i.e., the mediator) that encourages disputing parties to formulate own business solutions. Mediation conferences may be utilized either as an option to arbitration or litigation, or as a mandatory step prior thereto. In mediation, the neutral mediator assists the parties in reaching a settlement, but does not have the authority to make a binding decision or award. Mediation is a highly useful tool to resolve a broad range of conflicts within a variety of settings. The mediator facilitates communication and negotiation and promotes voluntary decision making by the parties to the dispute. Mediation serves various purposes, including providing the opportunity for parties to define and clarify issues, understand different perspectives, identify interests, explore and assess possible solutions, and reach mutually satisfactory agreements.

Arbitrator Services

Arbitration is the out-of-court resolution of a dispute between parties to a contract, decided by an impartial third party (i.e., the arbitrator).  It is undeniably faster and more cost effective than litigation in state or federal court in most jurisdictions. In national and international commerce each year, many millions of business transactions take place. It is not infrequent that disagreements develop over these business transactions. Many of these disputes are resolved by arbitration, the voluntary submission of a dispute to an impartial legal expert for a final and binding determination. Arbitration has been proven to be an effective way to resolve these disputes confidentially and economically.
